It honestly depends on the state. Some states flat out think surrogacy is illegal, you can not deliver there nor have the contract reconized in any courts. Some other states have where paid surrogacy is illegal and you could deliver there if comp portion is written outside of the contract and your IPs are a legally married couple. What state are you in and what state are they in?

i Live in Indiana and they live in new York. Which I have seen that both state dont recognize the contracts but that is all that it says.

Ditto Sarah. Depending on the state, you may have to deliver outside of either state in a more surrogacy friendly state.

Okay, so before you take my word to total heart, the info on Indiana that it's not illegal to be a surrogate but contracts are null and void. You would be best served by asking a lawyer but I recommend Hilary Neiman, she is nice, down to earth. New York, I am sure you know, it illegal in every way you can think of. Surrogacy is illegal to deliver there, contracts and if your a resident of NY, you have to deliver out of state.

ok so where would I go to do the IVF treatments and such? Thats where i get confused a lot.

Presuming you are the surrogate - your intended mother would go through the IVF stim cycle and retrieval, the clinic would fertilize the egg with intended fathers sperm, and when ready the clinic would transfer the embryos back to you.

I'd suggest doing a lot of research and ask a lot of questions before signing contracts and moving forward.

My previous IP's and I worked with a clinic IN Indiana....the transfer never occured for other reasons..however everything up to it had and it all took place in Indiana..I live in MO so was fine to deliver here. But for what it is worth..that was never an issue...
